In Texas, per 9-1 of the Texas Drivers Handbook, you should lower (dim) your headlights when you are: 1) Within 500 feet of an approaching vehicle. 3) When driving on lighted roads. 4) When driving in fog, heavy rain, sleet, snow, or dust.

if that, is in fact, a direct quote, then the problem lies in the verbiage "should' not as in "must"
There exists the option of not dimming your lights in the event you're dumb a**
There are plenty of those on the roads.
I'm sure Pete will agree with me on this - using a turn signal to change lanes in DFW is a sure fire way to get boxed in.
