San Angelo Times article: Burkhart suing everybody

Everybody always knows a guy. Pretty vague. The Burden for proof of Malice is near impossible to prove. Malice is more than banter, it has intent to harm attached to it. I’ve heard lots of blow hards talk of suing for slander but my problem is I know only of guys who knew a guy who knew guy that got sued. I would love to have an honest discussion, but as soon as things go the way the RS faithful can’t handle they start threatening a law suits. They will even sue their supposed good friends with high character who sided with RS (Lohn).
Real talk: all of this could have been avoided by not bending rules. RS had no business accepting a transfer that had prior contact days before. Or tell the kid no varsity. Don’t push so far you blow up your program.
Was the whole Hayes/Ethridge/Mullin transfer debacle worth the headache? Clearly no. RS had what they needed at home to get the job done. Why do it? What are y’all trying get from of all this extra stuff? I can’t imagine the cost of $ this whole ordeal has cost the school, coaches, and the booster club.
Let’s quit talking of suing people we don’t agree with and discuss more important things like can Richland get past Loraine and set up one of the greatest shootouts in San Saba county history against the high powered Indian offenseBending

Bending the rules does not mean breaking the rules.

Bending the rules does not mean breaking the rules.
There’s the mindset of Richland Springs Football. This is the type of character education kids get from the coaches all the way to the school board.

Paying a player is a against the rules but it’s not against the rules to pay the parent to work for the school (job ends when the kid graduates)

On a phone call you tell a kid it’s Against the rules to move for athletic purposes, so tell the UIL you want to come for One Act Play, or a Welding class.

This is how RS has gotten away with cheating, because “technically” it’s not cheating. You sound like Bill Clinton “technically not having sex with that woman”
Thanks for saying out loud what everyone has known for years.

The Burden for proof of Malice is near impossible to prove.

That is true. But it is not impossible, especially when the evidence is plentiful and the plaintiff is driven.

Could be that, at least in my case, I don't lie. Truth is a defense (if you actually read the law ... or sleep next to an attorney, lol). Therefore, I only know one person that actually pushed it too far. However, he is still suffering the consequences. Not surprisingly, you missed the point of me saying that. That being, why risk it? Why not just tell the truth instead of being a lying POS? Can you answer that?

That is not true. At least not for me. I appreciate the knowledge that some (very few) of you have. Even when it does not agree with what I think or is not what I want to hear. I'd be interested to see where you can find any post where you or anyone was directly threatened with a law suit. You won't. This is you ... spinning a false narrative again. Someone discussing a suit or the possibility of a suit based on observed behavior is not a threat. It is a warning. You can heed the warning or continue to be stupid.

We agree here.

discuss more important things like can Richland get past Loraine and set up one of the greatest shootouts in San Saba county history against the high powered Indian offense.

I've discussed this a number of times. Glad that you find it important too. Now just shutdown the lying BS and we can move forward.

Dilla, It's good to see someone of the RS persuasion mentioning honest discussions on this thread. Every time I requested one the RS crowd in years past to discuss new players for an upcoming season it was met with dead silence.

This will likely fall on deaf ears, but silence does not mean that all actions are condoned. Speaking for me and many RS folks here, we simply cannot confirm or do not know enough about what's going on within the athletic program to give any TRUTHFUL answers to some of the questions raised. For example, I got a PM from someone on this site about the kid from Mullin moving in 2 weeks before I heard about it from someone in RS. I could neither confirm nor deny what was going at that time, despite all of the crying going on here.

I know this might come as a shock to you, but it's better to remain silent when you have no knowledge of a subject than to start guessing ... unless it a discussion clearly about an opinion. But that's not how you roll. Your opinions are presented as fact. Then you get all bitchy when nobody wants to play your game. lol.

So did you move back to the area recently or just change your user name? I don't remember seeing your handle a year ago.

I was recruited. lol.

So not to beat a dead coyote, You don't know anything or any specifics of the RS football team (athletic program) past or present but want us to believe it is operated by the rules?? Just like the rest of your RS buddies.

As I suspected would happen, you missed the point entirely. Let me dumb it down for you: If you ask a question or make an accusation and I don't answer, it usually means 1) I am ignoring you, 2) I didn't see it or 3) I read it but do not have an answer based on fact to give you.

Hope this helps.

Appreciate the response.
The person that’s bringing up suing was you check post #50 on this thread. It’s just one of many.
Defamation cases the burden is on the plaintive to prove malice. It’s very hard to prove someone’s intent. Intent and action are not equal in the eyes of the law.
As for me being a lying pos, what have I said that wasn’t posted in a newspaper or transcripts from a hearing? There’s so much bad optics on Richland springs I don’t have to lie to make a point. Surely you can look at the evidence, The rule bending, The school board members releasing personal information about Brooksmith on Facebook and see that RS IS not as clean as they want everyone else to think they are.
With no malice, no hate, no jealousy, and honestly for the love of six man football The community of RS needs to clean up their school board, administration, and coaching staff.

You need to stand up to JB and spill the beans. Lol

Right. Nobody was threatened as you asserted. So, a better choice of words is in order. Otherwise it changes the narrative.

We mostly, but not entirely, agree here.

The releasing of the personal info on social media was less than optimal. I wish that a cooler head had prevailed prior to posting that. I do not know all of the board members, admin and coaching staff, so I cannot agree that they all need to go. I do believe that a PR person should be identified and vetted for future RSISD communications. I would like to see this person's role include some transparency into the various areas of the ISD, including athletics. Transparency is the only way to shut down the haters.

Great response. Maybe you should apply for the PR job!!

Your still an idiot and perpetually confused. How can written content "say out loud "?

You might want to take some time and read the law. I posted the link above. You are incorrect about the limitations, sweetness.

Regarding the UIL lawsuit ... I have my doubts that JB will be successful. However, backing a man in a corner results in a pushback. Note, I don't care if YOU think he was backed in a corner. Save it. He does think that and how far he is willing to go to reverse the UIL decision is anyone's guess. I am not aware of anyone that is funding this current effort. You might be right, there might be "10+ people" funding it. That money will only go so far. Then there will need to a different source of funds. Gee, I wonder where that might come from? I hear defamation suits pay handsomely. lol.
Deeply loyal ranchers with deep pockets are funding the legal fees.

You’re the reason why have warning labels. Let me rephrase so I can reiterate for you what everyone else got from the original statement. “Thanks for spelling out in plain English what everyone has known for years.” Is that better?
I see you started drinking early. Normally, your confusing post happen around 2am. Must be worried about all the money you threw away on players, coaches, and lawyers.

I worked 45 years as an actuary. I don't worry about money. Or anything else in this life. I have plenty of it. Deep pockets. The money I contribute to Jerry Burhart's legal fees is an investment.

Freddy Fender wrote a song that describes your behavior: Wasted Days and Wasted Nights. Try to stay out of the bar ditch of life.

You gotta watch who you give blessings to, that is illegal too. Superintendent won’t even acknowledge your existence, that should tell you it’s a slippery slope.

I asked this question before and never got a response, but does RS have to pay the good ole “Robin Hood” law like a lot of schools I know have too? How do they afford to pay all of these coaches and now attorney fees? Serious question
They do not and never have paid the Robin Hood tax.
